Aloha Hyundai Program Limited Availability Offer Terms and Conditions

1. Participation in Limited Offer. Sponsor will launch the “Aloha Hyundai” program (the “Program”) starting at 12:00 pm HST on February 27, 2024 and shall close the program at 12:00 pm HST on March 31, 2024 or until all Available Rentals (defined below) have been reserved, whichever occurs earlier (the “Program Period”). As part of the Program, Sponsor shall offer eligible guests a preferred rental vehicle reservation at the Enterprise Hilton Hawaiian Village location (2005 Kalia Rd, Honolulu, Hawaii 96815) for the IONIQ 5 EV or the TUCSON Hybrid, which gives eligible guests the opportunity to receive two (2) complimentary days of vehicle rental, subject to a returnable deposit of the actual retail value of the rental and an additional rental deposit of $200 upon reservation (each two (2) day complimentary rental, an “Available Rental”) (the foregoing special offer, the “Offer”). Eligible guests aged 21-24 will also be subject to a non-refundable underage fee of $25/day. The Offer is not guaranteed and Sponsor makes no representation that an Available Rental will be available for your requested date(s) and/or vehicle. The Offer is subject to very limited vehicle availability and other restrictions, including holiday and blackout dates, may apply. No other rental locations or vehicle makes/models are eligible as part of the Program. This Offer cannot be combined with any other discount and cannot be applied to a previous or existing reservation or rental. 

To apply to participate, please fill out the application form at https://www.enterprise.com/⁠ , including your full name and vehicle/date request information. Once you have submitted the application form, a member of the Enterprise Rent-A-Car team will reach out to you regarding availability and scheduling. The Offer is available and redeemable only by submitting a valid application form and will not be available or redeemable in any manner other than provided herein. Limit one (1) Available Rental per person or household (regardless of number of application forms submitted per person), only while supplies last. Duplicate requests shall constitute fraud. 

Any Available Rentals successfully requested for longer than two (2) days shall be billed at cost to the renter for the additional days. Except as noted by Enterprise Holdings or Sponsor at the time of reserving an Available Rental, taxes, fees, surcharges and optional products/services (such as DW and SLP) are not included and shall be the responsibility of the renter. 

2. Eligibility Requirements. Offer limited to residents of the fifty (50) United States and D.C., aged 21 or older, who meet standard Enterprise Holdings age, driver and credit requirements. Employees, officers and directors of Hyundai Motor America (“Sponsor”), Enterprise Holdings, Inc. and affiliates (“Enterprise Holdings”), and its and their parent companies, subsidiaries, affiliates, partners, franchisees, advertising and promotion agencies, manufacturers or distributors of promotion materials and their immediate families (parents, children, siblings, spouse) or members of the same household (whether related or not) of such employees, officers, directors are not eligible to participate. All federal, state and local laws and regulations apply. 

3. General Conditions. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be engaging in fraud or undermining the legitimate operation of this Offer or acting in an abusive, fraudulent, deceptive or disruptive manner or in violation of these Terms and Conditions. Any attempt by any person to undermine the legitimate operation of the Offer may be a violation of criminal and civil law and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. 

Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Offer should (in its sole discretion) virus, bugs, non-authorized human intervention, cheating, fraud, epidemics, pandemics or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Offer. Sponsor is not responsible for late, non-compliant, or misdirected submissions. Submissions not complying with all Offer requirements will not be honored. Theft, diversion, reproduction, transfer, sale or purchase of this Offer is prohibited and constitutes fraud. Void where prohibited, taxed, or restricted by law. All federal, state and local laws and regulations apply. 

By participating, you agree to release and hold harmless Sponsor, Enterprise Holdings, their advertising and promotion agencies, and their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors (collectively, the “Released Parties”), from and against any liability, loss, claims or causes of action arising out of participation in the Offer and/or receipt, use, participation in or misuse of any Available Rental, including, but not limited to: (a) unauthorized human intervention in the Offer; (b) technical, mechanical or printing errors; (c) the administration of the Offer (including any errors or unavailability of any Available Rentals) and/or the processing fulfillment or redemption of requests; and/or (d) product liability and/or personal injury claims, including without limitation any injury, death or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from your participation in the Offer or receipt or use of any Available Rental. You further agree that in no event shall the Released Parties be liable for attorney’s fees. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE THE RIGHT TO CLAIM ANY PUNITIVE, CONSEQUENTIAL, DIRECT, OR INDIRECT DAMAGES. 

By participating, you authorize Enterprise Holdings, Sponsor and/or Sponsor’s dealers to contact you regarding the terms of the offer and a potential rental, as well as to exchange information with one another and their respective affiliates regarding same. 4. Disputes: The parties waive all rights to trial in any action or proceeding instituted in connection with these Terms, including, without limitation, the Offer. Any controversy or claim arising out of or relating to these Terms and/or the Offer shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of California, Orange County. 

THESE TERMS AND THE INTERPRETATION THEREOF SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF CALIFORNIA WITHOUT REGARD TO ANY CONFLICT OF LAW RULES TO THE CONTRARY.

For any matters which are not subject to arbitration as set forth in these Terms and/or in connection with the entering of any judgment on an arbitration award in connection with these Terms and/or the Offer, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in or closest to Orange County in the State of California. The parties agree not to raise the defense of forum non conveniens.
